By accessing and using the Gaming Warehouse website (gamingwarehouse.com), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. We reserve the right to update these terms at any time, and continued use of the site constitutes acceptance of any modifications.
2. Products & Pricing
All product descriptions, images, and specifications are provided for informational purposes and are as accurate as possible. However, we do not warrant that product descriptions or pricing are error-free, complete, or current. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. Prices are listed in South African Rand (ZAR) and are subject to change without notice. Promotional pricing and discounts are valid only for the specified period.
3. Orders & Payment
By placing an order, you are making an offer to purchase a product. All orders are subject to availability and confirmation of the order price. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity. Payment must be made in full at the time of purchase. We accept major credit cards, debit cards, and other payment methods as displayed at checkout.
4. Shipping & Delivery
We offer various shipping options as detailed on our shipping information page. Delivery times are estimates and are not guaranteed. Gaming Warehouse is not responsible for delays caused by shipping carriers, customs, or other factors beyond our control. Risk of loss and title for items purchased pass to you upon delivery to the carrier. Free shipping promotions apply only to standard shipping within eligible areas and may have minimum order requirements.
5. Returns & Refunds
We accept returns within 30 days of delivery for most products in their original, unopened packaging. Items must be unused and in resalable condition. Custom PC builds and opened software are non-returnable unless defective. To initiate a return, contact our support team with your order number. Refunds will be processed to the original payment method within 5-10 business days after we receive and inspect the returned item. Shipping costs for returns are the responsibility of the customer unless the return is due to our error or a defective product.
6. Warranty
Individual components carry their respective manufacturer warranties. Custom PC builds from Gaming Warehouse come with a 2-year warranty covering parts and labor under normal use conditions. This warranty does not cover damage caused by misuse, modification, liquid damage, power surges, or unauthorized repairs. Warranty claims must be submitted through our support team with proof of purchase. We will repair or replace defective items at our discretion.
7. User Accounts
When you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. We reserve the right to suspend or terminate accounts that violate these terms or engage in suspicious activity. You must notify us immediately of any unauthorized use of your account.
8. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of Gaming Warehouse or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission. All trademarks, service marks, and trade names are the property of their respective owners.
9. Limitation of Liability
To the fullest extent permitted by law, Gaming Warehouse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our website or services. Our total liability for any claim arising from these terms or your use of the site shall not exceed the amount you paid for the specific product or service giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.
10. Privacy & Data Protection
Your privacy is important to us. We collect and process personal data in accordance with applicable data protection laws. By using our website, you consent to the collection and use of your information as described in our Privacy Policy. We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, or destruction. We do not sell your personal information to third parties.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of South Africa, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
